I, , (on behalf of , a minor child), understand that participation in activities or being present at locations operated by ITFA , LLC, is inherently dangerous. ITFA is engaged in the business of instructing and facilitating participating in the martial arts, exercise, and related activities, including Taekwon-Do, Brazilian Jiu-Jitsu, Boxing, Fitness Boxing, Bootcamp Training, Weightlifting, and Aerobics. I wish to utilize its grounds and facilities (“Premises”), its instruction and reaching, or otherwise participate or spectate, even though I know that it is inherently dangerous and could result in injury or death. The dangers include, but are not limited to: pulled muscles, bruising, broken bones, head injuries including concussions, impacts from the floor, objects or other participants, falls, , close contact with others, cuts, issues from over exertion – including heart attack, and other potential dangers and risks. I understand that I am responsible for knowing my own limits and following rules and directions and rules. Additionally, I must follow all rules and I have a duty to advise ITFA of any medical or other conditions which are unsafe or which I feel need to be addressed. I understand injury, or even death, may still result.
Therefore, in consideration for ITFA allowing me to be present or participate and other consideration:
1. I FULLY AND COMPLETELY ASSUME ALL RISKS ASSOCIATED WITH MY PRESENCE OR PARTICIPATION, WHETHER I AM ACTIVELY PARTICIPATING OR NOT, including death, injury, illness, theft or damage to personal property, or any other loss that occurs or damages sustained,
be they present or future, even if caused by the actions, inactions, or negligence of ITFA or its successors, members, owners, officers, managers, agents, employees, landlord, property owner, contractors, sponsors, advertisers, lessees, lessors, representatives, volunteers or anyone else related or associated with ITFA (collectively “Related Parties”), even if caused by the negligence of another;

2. I AGREE TO FOREVER RELEASE, WAIVE, DISCHARGE AND COVENANT NOT TO SUE ITFA TaeKwon-Do, LLC, and Related Parties from any and all liability, damages, loss, cause of action, claim, or demand. Any and all shall include, but not be limited, to those arising from death,
injury, illness, theft or damage to personal property, or any other loss that occurs or damages sustained, be they present or future, even if caused by the actions, inactions, or negligence of ITFA or Related Parties. I will not demand payment, make a claim or file a lawsuit and hereby forever waive those rights;

3. I AGREE TO INDEMNIFY AND HOLD ITFA TaeKwon-Do, LLC AND RELATED PARTIES HARMLESS. If ITFA, Related Parties or another incurs expenses, including attorney fees, trying to enforce this agreement or make a covered claim or action go away, those expenses are my responsibility and ITFA or a Related Party can demand I pay them or reimburse them, at their option;

4. This document is made on behalf of and shall be binding on myself as well as my spouse, heirs, successors, any person or entity entitled to subrogation, or other possible beneficiaries or representatives and will be binding even if the injury or loss is caused by the negligence or other fault of ITFA TaeKwon-Do, LLC, Related Parties, or other party intended to be protected by this document, but this release is not to be construed to cover fraudulent, willful or wanton conduct;

5. This document limits your rights forever, it does not expire. However, to update its records, ITFA may require you to re-sign this document from time to time. This release is in addition to and does not replace any other required waivers or previously sign waivers, which remain in full force and effect;

6. I represent that I have adequate health insurance and financial resources to cover any medical bills or other losses I, or my family or representatives may sustain;

I acknowledge that this agreement is intended to be as broad and inclusive as possible under the laws of the State of Oklahoma, which shall be the governing law with exclusive jurisdiction in the state courts of Tulsa County, Oklahoma. If any portion of it is held invalid, the balance shall continue in full legal force and effect; and

8. I understand that I can choose not to participate or even be present at ITFA, each of which is inherently dangerous, but I have decided to freely and voluntarily give up substantial rights by executing this document and wish to do so.
